Estée Lauder sues Walmart over alleged counterfeiting

Estée Lauder has filed a lawsuit against Walmart, alleging that the retail giant sells counterfeit products under several fragrance and skincare brands.

In the filing, Estée Lauder said the items, sold on Walmart’s website, used the Le Labo, La Mer, Clinique, Aveda, Tom Ford and Estée Lauder trademarks

The products listed in the lawsuit include counterfeit versions of Estée Lauder’s Advanced Night Repair serum, a Le Labo fragrance, a Clinique eye cream, a La Mer lotion, an Aveda hair brush and a Tom Ford fragrance. 

The beauty retailer described the action as trademark infringement and/or counterfeiting, adding that it had examined the items and confirmed they are inauthentic.

The company also said the accused products, which bear “counterfeit marks that are identical or substantially indistinguishable” to the original, are likely to confuse and deceive consumers.

While the products were sold by third-party sellers on Walmart’s online marketplace, Estée Lauder said the retail giant played an active role in facilitating those sales to shoppers.

The plaintiff requested an unspecified amount of monetary damages and a court order blocking Walmart from selling the alleged counterfeits.

In response, Walmart told CNBC that it was aware of the complaint and has “zero tolerance” for counterfeit products.  

“We will respond appropriately with the court when we are served,” the company added.
