U.S. Privacy Notice for Inside Retail US

  1. OUR PRIVACY PLEDGE

Our commitment is to put you, the user, first.  We strive to be transparent about how we collect and use your information, to keep your information secure, and to provide you with meaningful choices.  This Privacy Notice is meant to help you understand what information Octomedia Pty Ltd doing business as Inside Retail US (“us”, “our” or “we”) collect, why we collect it, and what we do with it.  This Notice applies to this website, our products, services, and technologies (we’ll collectively refer to these as “Services”).

  1. YOUR RIGHTS

Starting on January 1, 2020 the California Consumer Protection Act (CCPA) provides consumers (California residents) with specific rights regarding their personal information. Alternatively, as of the date of this Notice, you may have privacy rights in Colorado, Utah, Virginia, or Connecticut.  Because we care so much about your privacy, we are extending these rights to all U.S. residents.

You shall have the right to request from Inside Retail US: 

  1. A copy of all the information about you that is retained by us  
  2. That we correct any information that is incorrect, outdated or inaccurate
  3. The right to confirm if data is being processed
  4. The right to data deletion or the “right to be forgotten”
  5. The right to data portability
  6. The right to submit a request not to sell your information to third parties

Moreover, you have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.  Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request)
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • Sales, identifying the personal information categories that each category of recipient purchased; and
    • Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

We will not discriminate against you for exercising any of your rights.  Unless permitted by law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Inside Retail US will destroy personal information upon your request (by email) or when the personal information is no longer required. The exception to this is if the personal information is required in order to fulfill the purpose of Inside Retail US or is required to be maintained and/or stored in accordance with the law.

  1. WHO CAN MAKE A RIGHTS REQUEST, AND HOW?

A rights request can be made by you or your legal representative.  You may only make a verifiable consumer request twice within a 12-month period.  The verifiable request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.  However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

4. How To Complain About A Breach Of Privacy, And How The Complaint Will Be Dealt With

You can make a complaint to Inside Retail US’s internal dispute resolution team
(‘IDR’) regarding an interference with and/or misuse of your personal information by
contacting Inside Retail US via mail, telephone, or email.

In your communication you should detail to Inside Retail US the nature of your
complaint and how you would like Inside Retail US to rectify your complaint.

We will respond to that complaint within 7 days of receipt and will take all reasonable
steps to make a decision as to the complaint within 30 days of receipt of the complaint.

We will disclose information in relation to the complaint to any relevant credit provider
that holds the personal information the subject of the complaint.

In the event that you are not satisfied with the resolution provided, then you can make
a complaint to your state’s Attorney General’s Office.

5. Types of Personal Information That is Collected, Used, Processed & Held

Inside Retail US collects personal information for a variety of reasons. This personal information will be collected in the normal course of business and will relate to Goods and/or Services that are provided by Inside Retail US to clients. This information collected will be done so in the course of business where the client is a customer of Inside Retail US or when the client acts as a guarantor for another person or company that is a client of Inside Retail US. Inside Retail US will not collect information that is not relevant or sensitive in nature unless it is required in the normal course of business.

  • The personal information that is collected may include, but will not be limited to the following;
    1. Full name
    2. Address
    3. Date of birth
    4. Publicly available information which relate to the client’s activities in Australia
    5. Any information recorded in the National Personal Insolvency Index
    6. Electronic contact details including email, Facebook and Twitter details

We may also collect the following information/tracking data for statistical purposes and to help Us understand how to make Our Website more available and user friendly for You and to measure the success of any advertising activities We may undertake:

  • Your IP address.
  • The date and time of Your visits to Our Website.
  • Your clicks and activity on this Website.
  • The referring Website if any through which You clicked through to this Website.
  • Technical information on Your browser, device and operating systems.

Inside Retail US ensures that all personal information is held in a secure manner. Where applicable and to the best of Inside Retail US’s knowledge all computers or servers have the required security protections in place to safeguard and protect any personal information that is held by Inside Retail US.

They are designed to hold a modest amount of data (including personal information) specific to a particular client and website, and can be accessed either by the web server or the client’s computer. In so far as those cookies are not strictly necessary for the provision of Inside Retail US’s services, we will ask you to consent to our use of cookies when you first visit our website.

In the event that you utilize our website for the purpose of purchases/orders, Inside Retail US agrees to display reference to cookies and /or similar tracking technologies, such as pixels and web beacons (if applicable), and requests consent for Inside Retail US collecting your personal information which may include:

10. Privacy Officer (Responsibilities)

Inside Retail US has appointed an internal Privacy Officer to manage its privacy matters. The name of this officer is above. The privacy officer’s duties include (but are not limited to) the following:

The Privacy Officer needs to be familiar with both state and federal sectoral privacy laws.

If you complain to the state or to the FTC, or to any regulatory authority then the relevant data protection authority may contact the Privacy Officer to discuss the complaint, and to see whether there is any means of settling the matter. The Privacy Officer shall provide whatever assistance is necessary. The Privacy Officer may be asked to provide background information or identify the staff members who can do so.

Complaints
In the event that a complaint about privacy issues is received the Privacy Officer will:
1. Take ownership of the complaint and ensure that it is dealt with in a timely manner.
2. Acknowledge receipt of the complaint within 24 hours and advise the complainant of their rights.
3. Fully investigate the complaint.
4. Respond, with findings, to the complainant within 30 days of receipt.
5. Keep a record of all complaints received for ongoing review of policies and procedures.

Review
Formal review of this privacy policy shall be undertaken on a 6 monthly basis with the details of this review recorded by the Privacy Officer.
